These General Terms and Conditions (hereinafter referred to as “Conditions”) apply to the provision of international and domestic road freight transport services and the transport of goods for third parties by advanced ROAD s.r.o., ID No. 03311996, with its registered office at [insert address], registered in the Commercial Register kept by [insert court and file number] (hereinafter referred to as the “Carrier”).
The legal relationships concluded between the Carrier and the Sender in road freight transport are governed primarily by the CMR Convention (published as No. 11/1975 Coll., as amended) and, in matters not regulated by this Convention, supplementarily by the Civil Code No. 89/2012 Coll. Unless the damage was caused by the Carrier intentionally or through gross negligence, liability is limited to ten times the agreed freight charge.
The transport contract between the Carrier and the Sender is concluded upon written confirmation of the transport order by the Carrier. If the Carrier does not confirm the order but provides the vehicle for loading or otherwise demonstrably acts with the intention of performing the transport, the contract is deemed to have been concluded.
Prices are negotiated individually based on the Carrier's offer. The Sender is obliged to pay the freight charge according to the issued invoice with the due date specified in the order, usually within 14 days from the date of issue, or in cash upon delivery of the service. In case of late payment, the Carrier is entitled to charge default interest in accordance with § 1970 of the Civil Code.
Complaints are governed by the relevant provisions of the Civil Code and the CMR Convention. The Sender is obliged to claim obvious defects immediately upon receipt of the shipment, and hidden defects without undue delay after their discovery.
The Carrier processes personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR). Details on the processing of personal data are provided in a separate document, the Privacy Policy, which is available on the Carrier's website.
These Conditions are valid and effective from [insert date]. All disputes arising from contractual relationships shall be resolved before the competent court according to the Carrier's registered office. Amendments and additions to these conditions may only be made in writing.
